Terms of Service

These Terms of Service ("Terms") govern your use of the Thingdom Wallet application and related services ("Service") provided by Pentatonic Ltd ("we", "us", "our"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 17 years old to use the Service. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Responsibilities

  • You are responsible for maintaining the security of your account credentials, PIN, and recovery phrase
  • You must not share your recovery phrase with anyone
  • You are responsible for all activity under your account
  • Notify us immediately if you suspect unauthorised access

3. Thingventory and AI Services

The Service provides AI-powered product identification, valuation, and personalised shopping recommendations. These are provided on a best-effort basis:

  • Product identifications and valuations are estimates and may not be accurate
  • Shopping recommendations are personalised suggestions, not financial advice
  • We do not guarantee the accuracy of any AI-generated content

4. Marketplace

The Service facilitates peer-to-peer transactions between buyers and sellers:

  • We act as a platform facilitator, not as a buyer or seller
  • Sellers are responsible for the accuracy of their listings and for shipping items
  • Buyers are responsible for reviewing items before purchasing
  • Payments are held in escrow until delivery is confirmed
  • We may suspend or terminate accounts that engage in fraudulent activity

5. Payments and Financial Services

Payment processing is provided by third-party services:

Transaction fees, conversion rates, and network fees are displayed before you confirm any transaction.

6. Cryptocurrency

The Service supports USDC (a stablecoin) for certain transactions:

  • USDC is a cryptocurrency and its value may fluctuate
  • USDC balances are not bank deposits and are not insured by the FDIC, FSCS, or any government agency
  • Cryptocurrency transactions may be irreversible
  • We do not provide investment, financial, or tax advice
  • You are solely responsible for any tax obligations arising from cryptocurrency transactions
  • Availability of cryptocurrency features may vary by jurisdiction

7. Vault and Security

  • Your vault is encrypted locally on your device
  • Your 12-word recovery phrase is the only way to restore your vault if you lose access
  • We cannot recover your recovery phrase or vault data if lost
  • You are solely responsible for backing up your recovery phrase securely

8. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Post fraudulent, misleading, or counterfeit product listings
  • Attempt to circumvent security measures or access other users' accounts
  • Use the Service for money laundering or terrorist financing
  • Interfere with the operation of the Service
  • Scrape or harvest data from the Service

9. Content and Intellectual Property

You retain ownership of content you submit (photos, listings). By submitting content, you grant us a licence to use it to operate the Service (e.g., AI product identification, marketplace display). All Thingdom branding, software, and technology are owned by Pentatonic Ltd.

10. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for losses arising from cryptocurrency transactions, marketplace disputes, or AI inaccuracies
  • Our total liability is limited to the fees you paid to us in the 12 months preceding the claim

11. Termination

You may delete your account at any time via Settings. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use after changes constitutes acceptance.
